1. Agreement and eligibility
These Terms are an agreement between you and Whaleboom (shenzhen) Technology Co.,Ltd, operating under the brand “WhaleBoom.” By creating an account or using the service, you agree to these Terms and acknowledge our Privacy Policy. You must be at least 18 years old and have authority to act for the business you register. The service is intended for business use, not personal consumer use.
2. Public beta and charges
WhaleBoom is offered as a public beta. Features may be incomplete, change, have usage limits, or be unavailable temporarily. We may add, remove, or improve beta features and may apply reasonable limits to protect the service. No service-level agreement applies unless we sign one with you.
The launch offer is free and no credit card is required. Some future features may be paid. We will not charge you unless we clearly present the price and you expressly authorise the purchase. Separate purchase terms may apply at that time.
3. Accounts and security
Provide accurate account information, keep access credentials confidential, and promptly tell us if you suspect unauthorised access. You are responsible for activity performed through your account and for managing access granted to team members. Do not share passwords, email codes, secret keys, or administrator sessions.
4. Your content and permissions
You retain ownership of business information, prompts, uploads, trademarks, customer data, and other material you submit (“Your Content”). You grant WhaleBoom a non-exclusive, worldwide licence to host, copy, process, modify, display, and transmit Your Content only as needed to operate, secure, and improve the requested service and generate the outputs you request.
You confirm that you have the rights and permissions needed for Your Content, including photos, logos, customer records, reviews, and claims. You are responsible for the final published website and for keeping its information accurate.
5. AI-generated output
AI output may be incorrect, incomplete, non-unique, outdated, or inappropriate for your business. You must review and approve text, images, translations, claims, prices, legal notices, and recommendations before publishing or relying on them. WhaleBoom does not provide legal, medical, financial, or regulatory advice. Do not use generated output to make high-impact decisions about an individual.
6. Published sites, domains, and customer data
If you connect a domain, you confirm that you own or are authorised to control it and permit WhaleBoom and its infrastructure providers to verify and route that domain. You remain responsible for registration fees, renewals, DNS access, trademarks, and removing the connection when you stop using the service.
You are responsible for notices, consents, and lawful instructions relating to information collected from visitors or customers through your site. You must provide your own customer-facing privacy notice where applicable. Do not use WhaleBoom for sensitive or regulated information unless we expressly approve that use in writing.
7. Acceptable use
You may not use WhaleBoom to:
- Break the law, infringe rights, impersonate others, or publish deceptive, discriminatory, defamatory, or fraudulent material.
- Distribute malware, probe or bypass security, interfere with the service, scrape at unreasonable volume, or access another user’s data.
- Send unlawful spam, create fake reviews, manipulate rankings deceptively, or make unsupported health, safety, earnings, or performance claims.
- Submit child sexual abuse material, exploit minors, or promote violence or other illegal goods or services.
- Resell or reverse engineer the service except where applicable law expressly allows it.
8. WhaleBoom technology and feedback
WhaleBoom and its licensors own the service, software, interfaces, designs, and related intellectual property, excluding Your Content. If you provide feedback, you allow us to use it without restriction or payment, but we will not identify you publicly without permission.
9. Third-party services
Some features depend on third-party services such as domain registrars, cloud platforms, email services, authentication providers, and AI models. Their terms may apply to your direct use. We are not responsible for a third party’s independent service, content, or outage, although we remain responsible for our own obligations under applicable law.
10. Suspension, termination, and deletion
You may stop using the service at any time and may request account deletion using our deletion instructions. We may restrict or suspend access when reasonably necessary to prevent harm, address security or legal risk, enforce these Terms, or protect other users. Where practical, we will give notice and an opportunity to correct the issue.
11. Disclaimers
To the maximum extent permitted by law, the public beta is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. Nothing in these Terms excludes a warranty or right that cannot legally be excluded.
12. Limitation of liability
To the maximum extent permitted by law, WhaleBoom will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, data, or business interruption. WhaleBoom’s total liability arising from the service will not exceed the greater of USD 100 or the amount you paid WhaleBoom for the service during the 12 months before the event giving rise to the claim. These limits do not apply where liability cannot be limited by law.
13. Governing law and disputes
Before filing a formal claim, contact admin@whaleboom.com and allow us a reasonable opportunity to resolve it. These Terms are governed by the laws applicable in Shenzhen, Guangdong Province, China, without regard to conflict-of-law rules. Courts with jurisdiction in Shenzhen will hear disputes, except where mandatory local law gives you a different right or forum.
14. Changes and contact
We may update these Terms as the beta changes. We will post the revised Terms and update the date above, and provide additional notice where required. Continued use after the effective date of revised Terms means you accept them. Questions may be sent to admin@whaleboom.com.
